What Do We Do When We Can't Agree on Custody and Parenting Time?

It is common for couples ending their relationship to express this sentiment. Custody and parenting time is probably the most difficult issue to address during a breakup. Although it is the most emotionally intense area, it has at the same time, the least "hard rules." For everyone involved, the foremost goal should be to do what is best for the children. Since each parties idea of what is best for the children is often different, this is often an area of great disagreement and contention.

Do not despair. Most often, once the initial anger of the break up diminishes the spouses are able to work this out. The court will do everything in its power to assist the parties in resolving these issues and coming to an agreement without the court determining your children's future. You will be required to attend a mediation program provided by the court at no charge. If you are unable to resolve the issues during mediation the mediator will make a report to the court of issues in which you and your spouse found common ground and will make recommendations for the court as to the unresolved issues. Making a good and honest impression at mediation is imperative to your case.
